     A bill to amend 1978 PA 368, entitled

 

"Public health code,"

 

(MCL 333.1101 to 333.25211) by adding sections 16279 and 20196.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 16279. (1) A licensee or registrant who provides an

 

expectant parent or a new parent with prenatal care, postnatal

 

care, or genetic counseling shall direct the expectant parent or

 

new parent to the information described in subsection (2) if, after

 

administering or causing to be administered a test for Down

 

syndrome to the expectant parent or new parent, the licensee or

 

registrant receives a test result that is positive for Down

 

syndrome.

 


     (2) The department of health and human services shall make

 

available up-to-date, evidence-based information on Down syndrome

 

to licensees, registrants, and health facilities providing prenatal

 

care, postnatal care, or genetic counseling to expectant or new

 

parents in the manner described in subsection (3).

 

     (3) The department of health and human services shall make the

 

information described in subsection (2) available to an individual

 

who has received a positive test result from a test for Down

 

syndrome by including a link on the department's website to the

 

National Down Syndrome Society's website.

 

     (4) As used in this section:

 

     (a) "Down syndrome" means a chromosomal condition caused by an

 

error in cell division that results in the presence of an extra

 

whole or partial copy of chromosome 21.

 

     (b) "Health facility" means a health facility or agency

 

licensed under article 17.

 

     Sec. 20196. (1) A health facility or agency that provides an

 

expectant parent or a new parent with prenatal care, postnatal

 

care, or genetic counseling shall direct the expectant parent or

 

new parent to the information described in section 16279 if, after

 

administering or causing to be administered a test for Down

 

syndrome to the expectant parent or new parent, the health facility

 

or agency receives a test result that is positive for Down

 

syndrome.

 

     (2) As used in this section, "Down syndrome" means that term

 

as defined in section 16279.

 

     Enacting section 1. This amendatory act takes effect 90 days


after the date it is enacted into law.
