A bill to amend 1976 PA 451, entitled
"The revised school code,"
(MCL 380.1 to 380.1852) by adding sections 1278d and 1528.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1278d. (1) In addition to the requirements of sections
1278a and 1278b, beginning in 2017, the board of a school district
or board of directors of a public school academy shall not award a
high school diploma to a pupil unless the pupil has completed
during high school at least 2 hours of instruction concerning
sexual assault and sexual harassment. The instruction shall cover
at least identification and recognition of sexual assault and
sexual harassment, actions to be taken and resources available if
the pupil experiences sexual assault or sexual harassment, and
actions to be taken and resources available if the pupil knows an
individual who has experienced sexual assault or sexual harassment.
(2) After consulting 1 or more experts on sexual assault and
sexual harassment prevention or treatment, including, but not
limited to, the Michigan domestic and sexual violence prevention
and treatment board or the Michigan Coalition to End Domestic and
Sexual Violence, the board of a school district or board of
directors of a public school academy shall develop and make widely
available to pupils enrolled in the school district or public
school academy, as applicable, informational material relating to
sexual assault and sexual harassment. The informational material at
least shall explain that sexual assault or sexual harassment is not
the victim's fault and provide appropriate contact information of
organizations that offer assistance to a victim of sexual assault
or sexual harassment.
Sec. 1528. Beginning in 2016-2017, the board of a school
district or intermediate school district or board of directors of a
public school academy, together with a local organization that
receives funding from the Michigan domestic and sexual violence
prevention and treatment board and that serves the geographic area
of the school district, intermediate school district, or public
school academy, is encouraged to provide each of its teachers with
training at least every 5 years in responding to pupils who have
experienced sexual assault or sexual harassment. This training may
be provided as part of the professional development provided under
section 1527.
Enacting section 1. This amendatory act takes effect 90 days
after the date it is enacted into law.
