     A bill to amend 1978 PA 368, entitled

 

"Public health code,"

 

(MCL 333.1101 to 333.25211) by adding section 7333b.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 7333b. (1) Except as otherwise provided in subsection

 

(3), when issuing a prescription for an opiate to an adult patient

 

for the first time for outpatient use, a prescriber shall not

 

prescribe the patient more than a 7-day supply of the opiate.

 

     (2) Except as otherwise provided in subsection (3), a

 

prescriber shall not at any time prescribe a minor patient more

 

than a 7-day supply of an opiate. A prescriber who prescribes an

 

opiate to a minor shall discuss with the parent or legal guardian

 

of the minor the risks associated with opiate use and the reason

 

why the prescription is necessary.

 

     (3) If, in the professional medical judgment of the


prescriber, more than a 7-day supply of an opiate is required to

 

treat an adult or minor patient's acute medical condition or is

 

necessary for the treatment of chronic pain management or pain

 

associated with a cancer diagnosis, or for palliative care, the

 

prescriber may issue a prescription for the quantity needed to

 

treat the acute medical condition, chronic pain, pain associated

 

with the cancer diagnosis, or pain experienced while the adult or

 

minor patient is in palliative care. The prescriber shall document

 

in the patient's medical record the medical condition that requires

 

more than the 7-day supply of the opiate and shall indicate that a

 

nonopiate alternative was not appropriate to address the medical

 

condition.

 

     (4) This section does not apply to a prescription drug that is

 

designed for the treatment of substance abuse or opiate dependence.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
