     A bill to amend 1931 PA 328, entitled

 

"The Michigan penal code,"

 

(MCL 750.1 to 750.568) by adding section 81f.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 81f. (1) A person who assaults, batters, or assaults and

 

batters, or who solicits or encourages another person to assault,

 

batter, or assault and batter, an individual who is performing his

 

or her duties as a sports official while at a sporting event or

 

through social media is guilty of a felony punishable by

 

imprisonment for not more than 3 years or a fine of not more than

 

$10,000.00, or both.

 

     (2) This section does not prohibit a person from being charged

 

with, convicted of, or punished for any other violation of law

 

arising out of the same transaction as the violation of this

 


section.

 

     (3) As used in this section:

 

     (a) "Sporting event" means any of the following:

 

     (i) An organized competitive athletic activity between 2 or

 

more individuals.

 

     (ii) An event that is conducted before or after an athletic

 

activity described in subparagraph (i) to recognize or celebrate

 

that athletic activity or to recognize or celebrate 1 or more

 

individuals involved in that athletic activity.

 

     (b) "Sports official" means an individual who does either of

 

the following:

 

     (i) Officially administers or officially assists in

 

administering the rules at any sporting event, including, but not

 

limited to, a referee.

 

     (ii) Coaches or assists in coaching individuals involved in any

 

sporting event.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
