SENATE BILL No. 112

     A bill to amend 1957 PA 29, entitled

 

"An act to provide for the disposition of certain files and records

in the probate courts of this state,"

 

by amending section 1 (MCL 720.551).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. The probate courts of this state, subject Subject to

 

the provisions of section 5 of Act No. 271 of the Public Acts of

 

1913, as last amended by Act No. 59 of the Public Acts of 1955,

 

1913 PA 271, MCL 399.5, a probate court may order the destruction

 

of any of the following files and records when described in this

 

section if more than 6 years have passed since the last order of

 

the court in the case:case.

 

     (a) Proceedings taken for the payment of mothers' pensions

 

pursuant to Act No. 6 of the Public Acts of the Extra Session of

 

1907, as amended.

 


     (b) Proceedings taken for the hospitalization of adults

 

pursuant to Act No. 267 of the Public Acts of 1915, as amended,

 

being sections 404.101 to 404.112 of the Compiled Laws of 1948.

 

     (c) Proceedings This section applies to proceedings taken for

 

the hospitalization of crippled or afflicted children pursuant to

 

Act No. 158 of the Public Acts of 1937, as amended, being sections

 

722.201 to 722.244 of the Compiled Laws of 1948, or Act No. 283 of

 

the Public Acts of 1939, as amended, being sections 722.301 to

 

722.325 of the Compiled Laws of 1948.a child or youth with special

 

health care needs under part 58 of the public health code, 1978 PA

 

368, MCL 333.5801 to 333.5879.

 

     Enacting section 1. This amendatory act does not take effect

 

unless Senate Bill No.____ or House Bill No.____ (request no.

 

00760'15) of the 98th Legislature is enacted into law.
