SUMMARY:
Senate Bill 1264 would amend Public Act 222 of 1972, which provides for an official state personal identification card, to authorize the Secretary of State to forward to the Department of Licensing and Regulatory Affairs (LARA) the digitized photograph taken for a person’s official state personal identification card for use on an official state registry identification card issued under the Michigan Medical Marihuana Act, if a photograph is required by LARA for that registry ID card under departmental rules.
Currently, the Secretary of State (SOS) may only use a person’s digital photographic image and signature as specifically authorized in statute. The bill would expand the circumstances under which the Secretary of State may forward a person’s state ID photograph to another governmental agency to include forwarding it to LARA when that agency is fulfilling its duties regarding issuance of an official state registry identification card to a qualifying patient or primary caregiver under the Michigan Medical Marihuana Act if LARA promulgates rules requiring a photograph as a design element for the registry ID card.

BACKGROUND INFORMATION:
House Bill 6421 would place a similar provision in the Michigan Vehicle Code authorizing the SOS to forward to LARA, for the same purpose, a person’s digital photo taken for a driver or chauffeur license. That bill was passed by both the House and Senate and has been enrolled.
FISCAL IMPACT:
The bill would have no fiscal impact on the state or local units of government.
