TEACHING LICENSE/CERTIFICATE
FOR MILITARY SPOUSES

SUMMARY:
The bill would amend the Revised School Code to allow the state Superintendent of Public Instruction to grant a one-year renewable temporary teaching certificate to the spouse of a member of the US Armed Forces on active duty if certain conditions are met.
Specifically, the spouse seeking the certificate would have to:
· Hold a current teaching certificate or license issued by an equivalent credentialing department, board, or authority in another state of the United States or the District of Columbia.
· Provide proof acceptable to the state superintendent that either:
(1) Michigan is the home of record of the member of the Armed Forces; or
(2) The member of the Armed Forces is assigned to a duty station in this state and that the spouse seeking the teaching certificate is also assigned to a duty station in this state under the Armed Forces member's official active duty military orders.
The term "home of record" would mean the state of residence of a member of the Armed Forces at the time the member first enlisted in, or received a commission from, a branch of the US Armed Forces of the United States.
A temporary teaching certificate issued is valid for one year and may be renewed for additional one-year terms if the state superintendent determines the individual continues to meet the requirements specified in the bill. A temporary teaching certificate could be revoked for a conviction for which an individual's teaching certificate may be revoked under Section 1535a.
Also, under the bill, the state superintendent could deny a temporary teaching certificate to an individual for fraud, material misrepresentation, or concealment in the individual's application for a temporary teaching certificate or for a conviction for which an individual's teaching certificate may be revoked under Section 1535a of the code.
FISCAL IMPACT:
HB 4582 would have an indeterminate fiscal impact on the Department of Education (MDE), but there would be no fiscal impact for local school districts, intermediate school districts (ISDs), or public school academies (PSAs). The MDE would incur an indeterminate cost increase for administrative resources to allow the granting of temporary teaching certificates to a married spouse of an active duty member of the armed forces, which would require new oversight for this distinct population.
