CONTENT
The bill would amend the Highway Advertising Act to prohibit a billboard from advertising the purchase or consumption of, or facilitating access to, marihuana or marihuana-infused products.
Notwithstanding any other provision of the Act, all billboards within the State are subject to the Act and are prohibited from advertising the purchase or consumption of tobacco products. A person who violates this prohibition is responsible for a civil fine of at least $5,000 but not more than $10,000 for each day of violation.
Under the bill, subject to the same penalty, the Act also would prohibit a billboard from advertising the purchase or consumption of, or facilitating access to, marihuana and marihuana-infused products, as defined in Section 7106 of the Public Health Code and Section 3 of the Michigan Medical Marihuana Act, respectively.
("Marihuana" means all parts of the plant Cannabis sativa L., growing or not; the seeds of that plant; the resin extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant or its seeds or resin. Marihuana does not include the mature stalks of the plant, fiber produced from the stalks, oil or cake made from the seeds of the plant, any other compound, manufacture, salt, derivative, mixture, or preparation of the mature stalks, except the resin extracted from those stalks, fiber, oil, or cake, or any sterilized seed of the plant that is incapable of germination, or industrial hemp grown or cultivated, or both, for research purposes under the Industrial Hemp Research Act. "Marihuana-infused product" means a topical formulation, tincture, beverage, edible substance, or similar product containing any usable marihuana that is intended for human consumption in a manner other than smoke inhalation.)
