CONTENT

 

The bill would amend the uniform crime reporting Act to require law enforcement agencies to enter certain information pertaining to a missing or unidentified individual into the National Missing and Unidentified Persons System (NamUs).

 

The bill would take effect 90 days after its enactment.

 

Missing Individuals

 

Under the Act, if an individual who is any of the following is reported missing, the law enforcement agency receiving the report, after conducting a preliminary investigation, immediately must enter certain information regarding the missing individual into the Law Enforcement Information Network (LEIN), the National Crime Information Center (NCIC), and, if the missing individual is a child, the Child Information Clearinghouse established under the Act:

 

 --    An individual who has a documented physical or mental disability.

 --    An individual who was in the company of another under circumstances indicating that his or her safety may be in danger.

 --    An individual who disappeared under circumstances indicating that the disappearance was not voluntary.

 --    An individual who is missing as the result of a natural or intentionally caused catastrophe or extraordinary accident that causes the loss of human life.

 --    A child not described above.

 --    An individual not described above who is believed to be incapable of returning to his or her residence without assistance.

 

Under the bill, the information also would have to be entered into NamUs. The Act prescribes the information that must be included, including any other information that could assist in the individual's location, as determined by the Department of State Police and the LEIN Policy Council. Under the bill, the information also would have to include any information required to be entered into NamUs.

 

Dental Records

 

If the requirements described above are complied with, and the individual is not found within 30 days, the law enforcement agency that received the report must obtain the individual's dental records and enter them into the NCIC, and if the individual is a child, the Child


Information Clearinghouse. Under the bill, the dental records also would have to be entered into NamUs.

 

Unidentified Deceased Individual & Unknown Individual

 

When the unidentified body of a deceased individual is found, or when an individual whose identity is unknown and cannot be readily determined is found, the law enforcement agency receiving the report, after conducting a preliminary investigation, must enter certain information into the NCIC, and if the individual is a child, the Child Information Clearinghouse. The bill would require the information also to be entered into NamUs.

 

The Act prescribes the information that must be entered, including any other information that would assist in the identification of the body or the individual. Under the bill, the information also would have to include any information required to be entered into NamUs.

FISCAL IMPACT

 

The bill would have a negligible fiscal impact on the Department of State Police and local law enforcement agencies, as they should be able to accomplish the additional administrative and investigative duties required under the bill with existing personnel and appropriations.
