SENATE BILL No. 558

 

 

September 13, 2017, Introduced by Senator SCHMIDT and referred to the Committee on Outdoor Recreation and Tourism.

 

 

 

     A bill to amend 1957 PA 29, entitled

 

"An act to provide for the disposition of certain files and records

in the probate courts of this state,"

 

by amending section 1 (MCL 720.551), as amended by 2015 PA 92.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. Subject to section 5 of 1913 PA 271, MCL 399.5,

 

section 11 of the Michigan history center act, 2016 PA 470,

 

399.811, a probate court may order the destruction of files and

 

records described in this section if more than 6 years have passed

 

since the last order of the court in the case. This section applies

 

to proceedings taken for the hospitalization of a child or youth

 

with special health care needs under part 58 of the public health

 

code, 1978 PA 368, MCL 333.5801 to 333.5879.

 

     Enacting section 1. This amendatory act takes effect 90 days


after the date it is enacted into law.

 

     Enacting section 2. This amendatory act does not take effect

 

unless Senate Bill No. 564                                    

 

          of the 99th Legislature is enacted into law.
