A bill to amend 1966 PA 293, entitled
"An act to provide for the establishment of charter counties; to
provide for the election of charter commissioners; to prescribe
their powers and duties; to prohibit certain acts of a county board
of commissioners after the approval of the election of a charter
commission; to prescribe the mandatory and permissive provisions of
a charter; to provide for the exercise by a charter county of
certain powers whether or not authorized by its charter; and to
prescribe penalties and provide remedies,"
by amending section 1a (MCL 45.501a), as added by 1988 PA 195.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1a. Notwithstanding any provision of this act, if an
emergency
financial manager or a
financial management team has been
appointed
under the local government fiscal responsibility act, Act
No.
101 of the Public Acts of 1988, being sections 141.1101 to
141.1118
of the Michigan Compiled Laws, local
financial stability
and choice act, 2012 PA 436, MCL 141.1541 to 141.1575, with respect
to
a county governed by this act, then that emergency financial
manager or financial management team may exercise the authority and
responsibilities provided in this act to the extent authorized by
Act
No. 101 of the Public Acts of 1988. the local financial
stability and choice act, 2012 PA 436, MCL 141.1541 to 141.1575.
Notwithstanding any provision of this, if approved by the county
board
of commissioners in relation to a loan authorized under Act
No.
243 of the Public Acts of 1980, being sections 141.931 to
141.942
of the Michigan Compiled Laws, the
emergency municipal loan
act, 1980 PA 243, MCL 141.931 to 141.942, the local emergency
financial
assistance loan board created by Act No. 243 of the
Public
Acts of 1980 the emergency
municipal loan act, 1980 PA 243,
MCL 141.931 to 141.942, may exercise the authority and
responsibilities delineated by the terms of an order of the local
emergency financial assistance loan board.
Enacting section 1. This amendatory act takes effect 90 days
after the date it is enacted into law.
Enacting section 2. This amendatory act does not take effect
unless Senate Bill No.____ or House Bill No. 5337 (request no.
03826'17) of the 99th Legislature is enacted into law.
