A bill to amend 1976 PA 451, entitled
"The revised school code,"
(MCL 380.1 to 380.1852) by adding section 1268.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1268. (1) If a public school ceases operation, the board
of the school district or intermediate school district or the board
of directors of the public school academy operating the public
school shall grant a right of first refusal at current fair market
value for the sale of playground equipment located at the public
school to the municipality in which the playground equipment is
located.
(2) A board or board of directors that intends to sell
playground equipment described in subsection (1) shall provide
written notice of the intention to sell to the municipality in
which the playground equipment is located, in a form and manner
prescribed by the department.
(3) A municipality may exercise its right of first refusal
under subsection (1) not later than 60 days after a board or board
of directors provides notice under subsection (2) by providing
written notice to the board or board of directors, in a form and
manner prescribed by the department.
(4) As used in this section, "municipality" means a city,
township, or village.
Enacting section 1. This amendatory act takes effect 90 days
after the date it is enacted into law.
