A bill to amend 1988 PA 466, entitled
"Animal industry act,"
by amending section 30a (MCL 287.730a), as amended by 2002 PA 458.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec.
30a. (1) Privately owned Beginning
on the effective date
of the 2018 amendatory act that amended this section, live cervids
,
except those consigned directly to a state or federally inspected
slaughter
facility premises, shall not be
imported into this state.
unless
accompanied by an official interstate health certificate or
official
interstate certificate of veterinary inspection.
(2) An owner or a person in possession of a privately owned
cervid imported into this state before the effective date of the
2018 amendatory act that amended this section shall maintain for 7
years after the effective date of the 2018 amendatory act that
amended this section detailed records demonstrating compliance with
the following:
(a) (2)
Privately owned cervids imported into this state shall
be
The cervid is individually identified by an official
identification.
The official identification shall be is listed on
the official interstate health certificate or official interstate
certificate of veterinary inspection.
(b) (3)
Privately owned cervids A
cervid that was 6 months of
age
or older imported into this state, on the date of importation,
except
those a cervid consigned directly to a state or federally
inspected
slaughter facility premises, shall originate originated
directly from a certified brucellosis-free cervid herd as defined
in brucellosis in cervidae: uniform methods and rules, effective
September
30, 1998, or shall test tested
negative to an official
test for brucellosis within 30 days before importation.
(c) (4)
Privately owned cervids A
cervid that was 1 year of
age
or older imported into this state, on the date of importation,
except
those a cervid consigned directly to a state or federally
inspected
slaughter facility premises, must comply complied with 1
of the following before importation:
(i) (a)
Originate Originated directly from an official
tuberculosis accredited herd as outlined in bovine tuberculosis
eradication: uniform methods and rules, effective January 22, 1999,
approved
by veterinary services of the animal Animal and plant
health
inspection service Plant
Health Inspection Service of the
United
States department Department
of agriculture, Agriculture,
and all amendments to those publications thereafter adopted
pursuant to rules that the director may promulgate.
(ii) (b)
Originate Originated directly from an official
tuberculosis qualified or monitored herd as outlined in bovine
tuberculosis eradication: uniform methods and rules, effective
January
22, 1999, approved by veterinary services of the animal

and plant health inspection service Plant Health Inspection
Service
of the United States department Department of agriculture,
Agriculture, and all amendments to those publications thereafter
adopted pursuant to rules that the director may promulgate, and
receive
received an official negative test for tuberculosis within
90 days before importation.
(iii) (c)
Be isolated Was isolated from all other animals
until
it receives received 2 official negative tuberculosis tests
conducted no less than 90 days apart, with the first test conducted
no more than 120 days before importation.
(d) (5)
All privately owned cervids A
cervid that was less
than
1 year of age imported into this state, on the date of
importation,
except those a cervid consigned
directly to a state or
federally
inspected slaughter facility premises, must comply
complied with 1 of the following before importation:
(i) (a)
Originate Originated directly from an official

(iii) (c)
Be Was a purchased addition originating directly
from an official tuberculosis qualified or monitored herd as
outlined in bovine tuberculosis eradication: uniform methods and
rules, effective January 22, 1999, approved by veterinary services
of
the animal Animal and plant health inspection service Plant
Health
Inspection Service of the United States
department
Department
of agriculture, Agriculture, and all amendments to those
publications thereafter adopted pursuant to rules that the director
may
promulgate, and receive received
an official negative test for
tuberculosis within 90 days before importation.
(iv) (d)
Be Was isolated from all other animals until it
receives
received 2 official negative tuberculosis tests conducted
not less than 90 days apart, with the first test conducted no more
than 120 days before importation.
(e) (6)
Privately owned cervids A
cervid with a response other
than
negative to any tuberculosis test or brucellosis test are not
eligible
for interstate movement was
imported into this state
without
only upon receipt of permission from the director.
(f) (7)
Privately owned cervids A
cervid known to be affected
with
or exposed to tuberculosis or brucellosis are not eligible for
interstate
movement was imported into this state without only upon
receipt of permission from the director.
Enacting section 1. This amendatory act takes effect 90 days
after the date it is enacted into law.
Enacting section 2. This amendatory act does not take effect
unless all of the following bills of the 99th Legislature are
enacted into law:
(a) Senate Bill No.____ or House Bill No. 5770 (request no.
05139'17).
(b) Senate Bill No.____ or House Bill No. 5772 (request no.
05270'18).
