A bill to amend 1994 PA 350, entitled
"Public employee retirement benefits forfeiture act,"
(MCL 38.2701 to 38.2705) by amending the title and by adding
section 3a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
TITLE
An act to provide for the forfeiture of retirement benefits or
retirement health benefits by certain public employees under
certain circumstances; to prescribe the powers and duties of
certain retirement systems, state departments, courts, public
officials, and public employees; and to prescribe penalties and
provide remedies.
Sec. 3a. (1) Beginning with the effective date of the
amendatory act that added this section, a member of a state unit
that resigns or is terminated from state employment for cause of
willful and wanton neglect of duty forfeits his or her retirement
health benefit.
(2) As used in this section:
(a) "Retirement health benefit" means an annuity, allowance,
payment, or contribution to, for, or on behalf of a former state
employee or a dependent of a former state employee to pay for any
of the following components:
(i) Expenses related to drugs or medical, dental, hearing, or
vision care.
(ii) Premiums for insurance covering drugs or medical, dental,
hearing, or vision care.
(iii) Expenses or premiums for life, disability, long-term
care, or similar welfare benefits.
(b) "State unit" means that term as defined in section 2 of
the public employee retirement benefit protection act, 2002 PA 100,
MCL 38.1682.
