A bill to provide for a disability identification card; to
provide for its form and issuance; and to prescribe the powers and
duties of the secretary of state.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. As used in this act:
(a) "Department" means the department of state.
(b) "Disabled person" means a person who has a disability. As
used in this subdivision, "disability" means that term as defined
in section 103 of the persons with disabilities civil rights act,
1976 PA 220, MCL 37.1103.
Sec. 3. (1) A disabled person who is a resident of this state
may apply to the department for a disability identification card.
(2) An application for a disability identification card shall
be on a form prescribed by the department and shall contain
information regarding the disabled person's disability, and other
information determined necessary by the department.
(3) A disability identification card issued under this section
may contain information regarding the types of accommodations
needed by the disabled person and information for a police officer
regarding how to interact with the disabled person.
(4) The department shall provide informational materials and
training to police officers regarding disability identification
cards. The information materials and training required by this
subsection shall also include protocols on interacting with
disabled persons.
(5) The department may charge a fee for issuing a disability
identification card.
Enacting section 1. This act takes effect 90 days after the
date it is enacted into law.
