CONTENT
The bill would amend the Maintenance of Private Roads Act to allow the cost of maintenance or an improvement along a private road to be spread against each owner equally in the special assessment district that would benefit from the improvement or maintenance.
The Act allows a township board to contract for the maintenance or improvement of any private roads within the township by the creation of a special assessment district. Fifty-one percent of the property owners owning the frontage along a private road must request the improvement or maintenance by petition to the board. Once it has received a petition, the board may enter into a contract or make maintenance or improvement with the allocation of cost to be spread against all of the owners in the special assessment district benefiting on a pro rata frontage basis. Under the bill, the cost also could be spread against each owner equally in the special assessment district to be benefited.
The improvement and assessment of costs may not be completed until the special assessment district has created and assessed the properties with proper notice of public hearing to all of the owners of property within the benefiting special assessment district. Under the bill, this provision would apply to maintenance, in addition to improvement.
