A bill to create the emergency materials and supplies reserve program; to provide for certain materials and supplies to be stockpiled for use during a declaration of a state of disaster or state of emergency within this state; to prescribe duties and responsibilities of certain state departments; to require the promulgation of rules; and to create a fund.

the people of the state of michigan enact:

Sec. 1. This act shall be known and may be cited as the "emergency materials and supplies reserve program act".

Sec. 3. As used in this act:

(a) "Department" means the department of state police.

(b) "Disaster" means that term as defined in section 2 of the emergency management act, 1976 PA 390, MCL 30.402.

(c) "Emergency" means that term as defined in section 2 of the emergency management act, 1976 PA 390, MCL 30.402.

(d) "Fund" means the strategic preparedness fund created under this act.

(e) "Program" means the emergency material and supply reserve program created under this act.

(f) "State of disaster" means that term as defined in section 2 of the emergency management act, 1976 PA 390, MCL 30.402.

(g) "State of emergency" means that term as defined in section 2 of the emergency management act, 1976 PA 390, MCL 30.402.

Sec. 5. The department of state police shall create and operate the emergency material and supply reserve program. The program must do all the following:

(a) Require the department to create, through the state emergency operations center, a stockpile of materials and supplies that will be necessary to respond to a disaster or emergency within this state.

(b) Provide that the materials purchased to be stockpiled be manufactured in this state or the United States to the extent that maintaining the industry in this state or the United States would prove important in the response to a disaster or emergency in this state, as determined by the department.

(c) Allow for the use of the stockpiled materials during a state of disaster or state of emergency declared under the emergency management act, 1976 PA 390, MCL 30.401 to 30.421.

Sec. 7. (1) The strategic preparedness fund is created in the state treasury. The fund shall be administered by the department of state police.

(2) Money in the fund must be used for the following:

(a) Purchasing of materials to be stockpiled for use during a disaster or emergency in this state.

(b) Entering into contracts for future productions of materials to be used in response to a state of disaster or state of emergency declared by the governor under the emergency management act, 1976 PA 390, MCL 30.401 to 30.421.

(c) Supporting businesses or enterprises that would prove important in responding to a future disaster or emergency in this state.

(3) The state treasurer may receive money and assets from any source for deposit into the fund. The state treasurer shall direct the investment of the fund. The state treasurer shall credit to the fund interest and earnings from the fund investments.

(4) Except as otherwise provided by law, all unexpended money at the close of the fiscal year appropriated in response to a disaster or emergency must be deposited into the fund.

(5) Money in the fund at the close of the fiscal year must remain in the fund and must not lapse to the general fund.

(6) The department shall expend money from the fund, upon appropriation, for the purpose of the administration and operation of the program.
