A bill to amend 1976 PA 451, entitled

"The revised school code,"

by amending section 1175 (MCL 380.1175), as amended by 1995 PA 289.

the people of the state of michigan enact:

Sec. 1175. (1) Subject to subsection (2), all of the following are public holidays in the public schools of this state:

(a) January 1, New Year's day; the Day.

(b) The last Monday of May, Memorial or Decoration day; Day.

(c) July 4. ; the

(d) The first Monday in September, Labor day; the Day.

(e) The fourth Thursday of November, Thanksgiving day, and Day.

(f) December 25, Christmas day, shall be public holidays in the public schools of this state.Day.

(2) Beginning on the effective date of the amendatory act that added this subsection, Veterans' Day is a public holiday in the public schools of this state. As used in this subsection, "Veterans' Day" means November 11 of each calendar year.

(3) If 1 of these days a day described under subsection (1) or (2) falls on a Sunday, the Monday following shall must be a public holiday in the public schools of this state.

(4) A school session shall must not be held on the public holidays described in this subsection section in a public school in this state. The salary of a school officer or a teacher shall must not be affected by reason of the dismissal of school on the days public holidays described in this subsection.section.

(5) (2) On the third Monday in January in conjunction with the federal holiday, Martin Luther King, Jr. day; Day; February 12, Lincoln's birthday; Birthday; the third Monday of February, Washington's birthday; Birthday; September 17, the date of the adoption of the federal constitution; and the second Monday in October, Columbus day; and November 11, Veteran's day, Day, a school officer or teacher shall have each school under the officer's or teacher's control observe the day by a proper and appropriate commemorative exercise. A commemorative exercise may include or involve the assignment of schoolwork to teach the significance of the days described in this subsection, which shall must not be considered as legal holidays for schools.

(6) If a collective bargaining agreement or employment contract that provides a complete school calendar is in effect for employees of a school district, intermediate school district, or public school academy as of the effective date of the amendatory act that added this subsection, and if that school calendar is not in compliance with subsection (2), then subsection (2) does not apply to that school district, intermediate school district, or public school academy with regard to that collective bargaining agreement or employment contract until the expiration of that collective bargaining agreement or employment contract.
