A bill to amend 1978 PA 90, entitled
"Youth employment standards act,"
by amending sections 5 and 6 (MCL 409.105 and 409.106).
the people of the state of michigan enact:
Sec. 5. (1) An Except as otherwise provided in subsection (2), the issuing
officer shall issue a work permit only upon on an in-person application
in person by the
minor desiring employment and after having the following
papers have been examined, approved, and filed: the following papers:
(a) A statement of
intention to employ the minor,
signed by the prospective employer or by a person authorized by the prospective
employer, setting forth the general nature of the occupation in which the
employer intends to employ the minor, the hours during which the minor will be
employed, the wages to be paid,
and other information the department of education, in cooperation with the
department of labor and economic
opportunity, requires.
(b) Evidence showing that
the minor is of the age required by this act. Proof of age shall must be established by one of the
following:
(i) A certified copy of the birth record or any other proof of
age showing the place and date of birth.
(ii) A certified copy
of valid operator's license issued by this state clearly showing date of birth.
(iii) The school record
or the school census record.
(iv) The sworn
statement of the minor's parent or guardian, together with a corroborating
statement of a physician.
(v) If documentary
proof as described in subparagraphs (i) to (iv) is not obtainable, the issuing officer may accept other
documentation as established by department of education rules.
(2) During a state of disaster or a state of emergency issued
by the governor under the emergency management act, 1976 PA 390, MCL 30.401 to
30.421, the requirement that a work permit application must be made only by an
in-person application by the minor desiring employment is suspended. The
issuing officer may allow the minor desiring employment to submit the
application materials described in subsection (1) using any of the following
methods:
(a) Electronic transmittal of the application materials,
which includes electronic mail or facsimile.
(b) Mailing the application materials.
Sec. 6. (1) Work permits shall Except as otherwise provided in
subsections (4) and (5), a work permit must be issued in the form
prescribed by the department of education in cooperation with the department of
labor and economic opportunity and
in accordance with instructions so prescribed. The color of work permits for minors a work permit for a minor under

the occupation and industry in which the minor is employed, the employer's name
and address, and other information required by the department of education.
(2) The department of education shall promulgate rules
prescribing standards for the issuance of work permits, which shall must include the following
factors:
(a) Evidence of age.
(b) Standards of work as established by the department of
labor and economic opportunity and
federal regulation.
(c) Statutory requirements.
(3) A fee shall not be charged for a
work permit or other record required by this act.
(4) If
the governor declares a state of disaster or a state of emergency under the
emergency management act, 1976 PA 390, MCL 30.401 to 30.421, and the issuing
officer issues a work permit electronically to a minor desiring employment, the
requirement that a work permit form must be in a color described under
subsection (1) is suspended.
(5) A
work permit issued during the period described in subsection (4) and printed in
a form in a color other than the color described in subsection (1) is valid for
90 days after the termination of the state of disaster or state of emergency.
The issuing officer shall issue the minor a work permit in the color described
under subsection (1) before the expiration of the 90-day period.
(6) As
used in this section:
(a)
"State of disaster" means that term as defined in section 2 of the
emergency management act, 1976 PA 390, MCL 30.402.
(b)
"State of emergency" means that term as defined in section 2 of the
emergency management act, 1976 PA 390, MCL 30.402.
