A bill to amend 1990 PA 187, entitled
"The pupil transportation act,"
by amending section 5 (MCL 257.1805), as amended by 2006 PA 107, and by adding section 32.
the people of the state of michigan enact:
Sec. 5. (1)
"Motor bus" means bus and "motor
carrier of passengers" mean means motor carrier as those terms as are defined
in section 3 of the motor bus transportation act, 1982 PA 432, MCL 474.103.
(2) "Nonpublic
school" means that term as defined in section 5 of the revised school
code, 1976 PA 451, MCL 380.5.
(3) "Public
school" means that term as defined in section 5 of the revised school
code, 1976 PA 451, MCL 380.5.
(4) "Rule"
means a rule promulgated pursuant to the administrative procedures act of 1969,
1969 PA 306, MCL 24.201 to 24.328.
(5) "School"
means either a public school or a nonpublic school, or both.
(6)
"School district" means that term as defined in section 6 of the
revised school code, 1976 PA 451, MCL 380.6.
(7) "Stop-arm camera system" means a device that is affixed to a school bus that is synchronized to automatically capture the photograph or record the video of a motor vehicle that fails to stop for a school bus or passes a school bus in violation of section 682(1) of the Michigan vehicle code, 1949 PA 300, MCL 257.682.
Sec. 32. (1) A school bus may be
equipped with a stop-arm camera system for the purpose of capturing the
photograph or recording the video of an operator of a motor vehicle who fails
to stop for the school bus or who overtakes the school bus while the school bus
is stopped and is displaying 2 alternately flashing red lights located at the
same level.
(2)
A school district may do any of the following:
(a)
Install and operate a stop-arm camera on a school bus.
(b)
Enter into a contract with a private vendor to install and operate a stop-arm
camera on a school bus.
(c)
Enter into an agreement with a local or state law enforcement agency to report
a violation of section 682(1) of the Michigan vehicle code, 1949 PA 300, MCL
257.682, and to provide the photograph captured or video recorded by the
stop-arm camera to the local or state law enforcement agency.
Enacting section
1. This amendatory act does not take effect unless all of the following bills
of the 100th Legislature are enacted into law:

(b) Senate Bill
No. 1100.
