A bill to prohibit certain employers from offering or contributing to certain health insurance coverage for employees; and to provide sanctions and remedies.

the people of the state of michigan enact:

Sec. 1. As used in this act:

(a) "Employee" means an individual who receives compensation from an employer for performing services for the employer under an express or implied contract of hire.

(b) "Employer" means an individual or entity that employs 1 or more employees. Employer does not include this state, an agency of this state, or a political subdivision of this state.

Sec. 3. (1) If an employer offers or contributes to health insurance coverage for its employees but, because of the employer's religious objection, does not offer or contribute to health insurance coverage for female birth control, the employer shall not offer or contribute to health insurance coverage for either of the following:

(a) Male birth control.

(b) Erectile dysfunction.

(2) An employer that violates subsection (1) shall pay to each affected employee an amount equal to the cost the employee would incur to obtain the equivalent coverage.
