CONTENT

 

House Bill 5262 (H-3) would amend the Insurance Code to require an insurer that delivers, issues for delivery, or renews in the State a health insurance policy to provide a nonopioid directive form to insureds upon enrollment.

 

House Bill 5263 (H-1) would amend the Insurance Code to require an insurer that delivers, issues for delivery, or renews in the State a health insurance policy to make available to its insureds a nonopioid directive form on its internet website.

 

House Bill 5264 would amend the Public Health Code to require a hospital to make available to the public the nonopioid directive form developed under Section 9145 on its internet website.

 

As used in House Bills 5262 (H-3) and 5263 (H-1), "nonopioid directive form" would that term as defined in Section 9145 of the Public Health Code. (Section 9415 requires the Department of Health and Human Services to develop a nonopioid directive form that indicates that an individual who has executed the form or who had a form executed on the his or her behalf may not be administered or offered a prescription for an opioid.)

 

House Bills 5262 (H-3) and 5263 (H-1) both state that they apply to policies delivered, executed, issued, amended, adjusted, or renewed in the State, or outside of the State if covering Michigan residents, after March 31, 2022.
