CONTENT
House Bill 5695 would amend the Michigan Liquor Control Code to allow an individual 16 years of age or older employed by a wholesaler to build a display of, mark the price of, rotate, and place brands that were represented or sold by the wholesaler for an off-premises retailer.
House Bill 5696 would amend the Code to reduce the age, from 18 to 16 years of age, of a person who need not be licensed as a salesperson to engage in certain activities.
House Bill 5726 would amend the Youth Employment Standards Act to allow a work permit to be issued for a minor 16 years of age or older for employment with an establishment where alcoholic beverages are distributed.
House Bill 5695
Currently, the Code prohibits a licensee from allowing an individual less than 18 years of age to sell or serve alcoholic liquor. Under the bill, this provision would not prohibit a wholesaler's employee who was 16 years of age or older from doing any of the following:
-- Building a display of those brands that were represented or sold by the wholesaler for an off-premises retailer.
-- Marking the price on those brands that were representing or sold by the wholesaler for an off-premises retailer.
-- Rotating brands that were represented or sold by the wholesaler for an off-premises retailer.
-- Placing brands that were represented or sold by the wholesaler for an off-premises retailer.
House Bill 5696
Generally, the Code prohibits an individual from selling, delivering, promoting, or otherwise assisting in the sale of alcoholic liquor in any manner to a retailer unless he or she is licensed as a salesperson. This provision does not require an individual who at least 18 years of age and who only does any of the following to be licensed as a salesperson:
-- Builds a display of those brands that are represented or sold by the individual's employer for an off-premises retailer.
-- Marks the price on those brands that are representing or sold by the individual's employer for an off-premises retailer.
-- Rotates brands that are represented or sold by the individual's employer for an off-premises retailer.
-- Places brands that are represented or sold by the individual's employer for an off-premises retailer.
-- For an individual who holds a Michigan commercial driver license or chauffeur's license, transports and delivers liquor in a vehicle licensed by the Liquor Control Commission.
The bill would reduce, from 18 years of age to 16 years of age, the age at which this provision applies.
House Bill 5726
The Youth Employment Standards Act prohibits a work permit from being issued that authorizes the employment of a minor 16 years of age or older in, about, or in connection with an establishment where alcoholic beverages are distilled, rectified, compounded, brewed, manufactured, bottled, consumed, distributed, sold at retail, or sold for consumption on the premises unless the sale of food or other goods constitutes at least 50% of the total gross receipts. The bill would remove the word "distributed".
