A bill to amend 1978 PA 368, entitled

"Public health code,"

by amending section 13321 (MCL 333.13321).

the people of the state of michigan enact:

Sec. 13321. (1) The department shall enforce this part and the rules promulgated pursuant to under this part.

(2) The department may suspend, revoke, or deny a class IV installation license.

(3) Upon a finding that an emergency exists requiring immediate action to protect occupational or public health and safety, the department may issue an order, without notice or hearing, reciting the existence of the emergency and providing for the protection of public health and safety. Notwithstanding this part or the administrative procedures act of 1969, the order shall must be effective immediately. If the department issues an order under this subsection, the department shall provide notice of the order to all of the following within 24 hours:

(a) The senate majority leader and the speaker of the house of representatives.

(b) Standing committees in the senate and house of representatives that deal primarily with oversight.

(c) Any other standing committee in the senate and house of representatives that the department considers necessary or appropriate.

(4) A person to whom the an order is directed under subsection (3) shall comply immediately with the order but on application to the department shall must be afforded a hearing within 15 days. On the basis of the hearing, the emergency order shall must be continued, modified, or revoked not later than 30 days after the hearing.
