A bill to amend 1931 PA 328, entitled
"The Michigan penal code,"
(MCL 750.1 to 750.568) by adding section 147c.
the people of the state of michigan enact:
Sec. 147c. A person who makes a false report of the
commission of a crime or suspected commission of a crime based solely on the
race or ethnicity of the alleged perpetrator of the crime and not on actual
suspicion that a crime has been or might be committed, or intentionally causes
a false report of the commission of a crime to be made based solely upon the
race or ethnicity of the alleged perpetrator and not on actual suspicion that a
crime has been committed or might be committed, to a peace officer, police
agency of this state or of a local unit of government, 9-1-1 operator, or any
other governmental employee or contractor or employee of a contractor who is
authorized to receive reports of a crime is guilty of a crime as follows:
(a) For a first
offense, the person is guilty of a misdemeanor and shall be punished by a fine
of $1,000.00 and be required to complete 50 hours of community service with a
group or nonprofit whose mission is to advance equity and justice for
historically marginalized, disenfranchised, and oppressed peoples.
(b) For a second offense, the person is guilty of a felony punishable by imprisonment for not more than 2 years or a fine of not more than $2,500.00, or both.
Enacting section 1. This amendatory act takes effect 90 days after the date it is enacted into law.
