SENATE BILL NO. 793
A bill to amend 1954 PA 116, entitled
"Michigan election law,"
(MCL 168.1 to 168.992) by adding section 931c.
the people of the state of michigan enact:
Sec. 931c. (1) An individual who communicates to any individual that he or she will physically harm an individual who is an election official and who does so because of the individual's status as an election official is guilty of a misdemeanor punishable by imprisonment for not more than 1 year or a fine of not more than $1,000.00, or both.
(2) Except as provided in subsection (3), an individual who assaults or assaults and batters an individual while the individual is performing his or her duties as an election official or because of the individual's status as an election official and causes the individual any physical injury is guilty of a felony punishable by imprisonment for not more than 2 years or a fine of not more than $1,000.00, or both.
(3) An individual who assaults or assaults and batters an individual while the individual is performing his or her duties as an election official or because of the individual's status as an election official and causes the individual serious impairment of a body function is guilty of a felony punishable by imprisonment for not more than 5 years or a fine of not less than $1,000.00 or more than $5,000.00, or both.
(4) As used in this section:
(a) "Election official" means a public officer or public employee who has a duty to perform in connection with an election conducted under this act.
(b) "Serious impairment of a body function" means that phrase as defined in section 58c of the Michigan vehicle code, 1949 PA 300, MCL 257.58c.
