CONTENT
The bill would amend the juvenile code to extend, from three months to six months, the maximum period for a juvenile to complete the terms of a consent calendar plan.
The bill would take effect October 1, 2024.
BRIEF RATIONALE
Generally, a family division of a circuit court may proceed in an informal manner referred to as a consent calendar upon determination that formal jurisdiction over a juvenile is not needed. According to testimony, Public Act (PA) 291 of 2023 and PA 301 of 2023 intended to codify consent calendar recommendations made by the Task Force on Juvenile Justice Reform, which was created by Governor Whitmer's Executive Order 2021-6 and recommended that courts should limit the time a youth can be placed on a consent calendar to no longer than six months. Effective October 1, 2024, and in the following order, PA 291 of 2023 requires a juvenile to complete the terms of a consent calendar case plan within six months and PA 301 of 2023 amends that language to require a juvenile to complete the terms of a consent calendar plan within three months. It has been suggested that the language be amended again to reflect the Task Force's recommendation of six months.
