SENATE BILL NO. 1151

A bill to amend 1978 PA 368, entitled

"Public health code,"

(MCL 333.1101 to 333.25211) by adding section 16225.

the people of the state of michigan enact:

Sec. 16225. (1) Notwithstanding section 16174, 16221, or any other section in this article to the contrary, all of the following apply to a licensee, a registrant, or an applicant for licensure or registration who is subject to discipline or other penalty in another state for conduct that is prohibited in that state but would otherwise be protected under section 28 of article I of the state constitution of 1963 or would be considered engaging in a legally protected health activity:

(a) A disciplinary subcommittee shall not impose a sanction against the licensee or registrant or the applicant for licensure or registration under section 16226 for the conduct described in this section on the basis that the licensee or registrant was subject to discipline or other penalty for the conduct in the other state.

(b) A board or task force or the department shall not deny an application for licensure or registration for the conduct described in this section on the basis that the licensee or registrant was subject to discipline or other penalty for the conduct in the other state.

(2) As used in this section, "legally protected health activity" means that term as defined in section 2170 of the revised judicature act of 1961, 1961 PA 236, MCL 600.2170.

Enacting section 1. This amendatory act does not take effect unless Senate Bill No. 1152 of the 102nd Legislature is enacted into law.
