SENATE BILL NO. 403
A bill to amend 1978 PA 368, entitled
"Public health code,"
(MCL 333.1101 to 333.25211) by adding section 7333c.
the people of the state of michigan enact:
Sec. 7333c. (1) A pharmacist who receives a lawful order from a prescriber for addiction medication shall dispense the addiction medication without undue delay to the ultimate user.
(2) A pharmacy shall have not less than a 2-week supply of addiction medication in stock at all times in the pharmacy.
(3) As used in this section:
(a) "Addiction medication" means a controlled substance approved by the United States Food and Drug Administration for the treatment of an opioid use disorder, including, but not limited to, buprenorphine.
(b) "Undue delay" means a delay intended to obstruct a patient's access to the addiction medication or that is not a valid delay.
(c) "Valid delay" means a delay caused by fulfilling the requirements of this article, part 177, or a rule promulgated under this article or part 177, or any other delay commonly associated with the practice of pharmacy.
